A sheriff came to my dor today to serve me!! AND he couldn't tell me what it was about AND the lady at the help line said "Well, I'll see if I can get back to you sometime today". Guess who never called?
AND
It's for a trial; NC vs. my ex! Okay for those of you that know me the break up with this psycho was some of the most horrible months I've been through. Now I have to go face him in court? You'd think that the state would consider my restraining order again him and not make me go to court and have to see his freaking horrible disgusting face...jerk! (maybe this should go in the Vent section)
Why in the world are they subpoenaing me? All I know is that it has something to do with domestic violence (shocker!) but I wonder if it has anything to do with me? Ahhh, I'm sooo freaking out here:(

Oh man! I'm sorry you have to go through that! You already have an order against him...why would the state want to feed the fire? :eek:

Oh my....maybe he's charged in another case and they want you on the opposite side from him. Maybe someone else is trying to do him in????? They just want your testamony to help.... When do you have to go to court?:)

Gosh I have no clue what to think of this. Maybe someone else charging him with abuse? But then it would be a personal name vs. timothy bassett not The state vs. him. I know they just want to hear my voice to help prosecute him, but after tons of death threats, and abuse, and already having to be removed by the cops TWICE from my house (to make a long story short...) now they want me to come to the same court house as him...
My mom even had to get a restraining order against him

It totally is, but mainly cause I NEVER want to see him again. He makes me nevous and is just such an absurd person. You would not believe some of the things he's done...

Maybe you can at least get your parents or some big mean burly guy to go with you. I would check in to what this is all about. Can you ask your lawyer to find out for you?

Well I wish I could help you out more, but my husband is skinny as a rail and definitely not hot by anyone's definition....LOLOL but today is our 32nd wedding anniversary so I guess I have to keep him now....:D

A Subpoena means you are being called to testify against your ex. The DA obviously has good reason to believe that you have compelling evidence against him...evidence taht will help put him away. You can go talk to the DA and ask them for protection if you testify, if you are that afraid of him. If they need your testimony bad enough, they will give you protection. Just think, your testimony will be helping put away this man so he cannot hurt any other women. Wouldn't hate for another woman to go through what you, and obviously other women, have been through? Go talk to the DA about protection, and then testify against that Bast**** so he can't do this to anyone else. :(

There have obviously been criminal charges brought on your ex. The state is who prosecutes CRIMINALS. Therefore, it would be the State against your Ex.

Okay thanks that's reassuring...I would feel much better if I didn't have to see him...ahhh I so thought this ordeal was over! At least I wasn't being arrested today when the sheriff came. When I looked out of the peep hole I started thinking of things that I could be getting arrested for! Ha!

One option if the DA will let you, is give a sworn written statement that can just be read in court so you don't have to be there in person. However, that can only be done at the "Grand Jury" trial. They cannot do that at the actual trial because with a written testimony, your ex's lawyer cannot cross examine you. If I were you, I would call the DA and make an appointment to sit down and express your concerns to them. If they need your testimony bad enough, they will work something out with you. You can't just "blow it off," though. If you just don't show up, they can hold you in contempt of court and fine you or put you in jail. So, you really need to contact the DA.
