The survey is done!

The survey went better than I'd dared hope.
The man next door was arrested yesterday so is still in jail, so wasn't here to cause problems during the survey. His friend who lives there with him came out twice to talk with the surveyor, but didn't get nasty about anything. He did call the soon-to-be ex wife, who rushed over to check things out. She stated in front of the surveyor that since she's moved, she has no concerns about us putting up a fence. The land is in HER name, so the surveyor said he'd go ahead with the fence.
We lost about 53 feet on the back side of our house, which put that lot line between us and our Amish neighbors right through our back porch. I have already talked with them and they've agreed to let us have that 53 feet provided we pay for the changes to the legal descriptions and let them put a barbed wire fence along the new boundary so they can pasture their horses there without objecting. I told them we love horses, would gladly pay for the legal work, and we shook hands on it. So the surveyor included that in with the boundaries he marked out. It gives us an additional 1/5 of an acre.

The side toward the problem neighbor also moved over 53 feet. We now own far more than we realized or hoped for on that side. They'd tried to claim up to our garage; we had tried to claim along the line where we put the young willow trees... You can see by the picture how much additional land we gained. In the background you can see how much of their garden is on our land. We also ended up with a nice big patch of raspberries behind the garden. From where the garden starts by the surveyor, the propery extends back about70 feet into the trees.

Note the side of the gold garage which is ours... and the placement of the surveyor and his equipment which are on the boundary line. The land in between is what we gained by doing the survey.That width, and out to the road behind where the picture was taken.

Congratulations Tink!!! Looks like you've got plenty more to mow.....lol I'm so glad your neighbor was out of the way while the survey was being done. I just hope he doesn't cause problems when he returns. Since the land is in her name, it shouldn't be a problem....hopefully!

Loved all the doggie pictures too. They are beautiful!!

Thanks ladies I'm VERY relieved to have this much done.
The dw stopped in to tell me that she plans to sign a quit claim to give the land to the dh... so it looks like we may be dealing with him soon. I seriously doubt he will be able to come up with the cash to do a survey or hire a lawyer to take us to court to contest it. If he did, he'd have to prove that the line is incorrect, which is highly unlikely since it was a GPS survey.
She said he'll be in jail at least the rest of the week, so for now I can relax.

I'm amazed at how much land we gained between what we discovered to be ours on the one side and what we're getting from the amish family on the other side. I think we're going to need a riding mower in the near future.

Tink,

That is great news! Your guardian angels were with you, putting that creep in jail at just the right time.

Now, you can get on with your life on your beautiful land.

Can you get what the Amish couple agreed to in writing. I know I watch too much of The People's Court, but I just do and all of her cases are from people who have verbal agreements.

Judy, we're not only getting it in writing, we're registering it at the courthouse for their protection as well as ours. It will become part of their and our land deeds. They'd been wanting to do this for a couple of years and the woman we're buying the place from refused to respond to their requests. So they're as happy about doing this as we are!

The woman leaving our meth-head neighbor called me a bit ago asking me to have her soon-to-be EX dh's friend contact her today because she's found a house they can rent "together". The friend had been living there for over a year with them. So not only is she leaving him, but his best friend is leaving him WITH her.

I dread to think how he's going to react when he gets out of jail to find them both gone and us having staked claim to a sizeable piece of what he considers to be HIS lawn!

I think it's gonna be a lot to handle for a guy who's known to have anger, drug, alcohol and depression issues. Anyone have a empty spare room I could use for a couple weeks? LOL I don't think I want to witness his reaction.

Hey Tink, when is the jerky neighbor suppose to get out of jail? I'm nervous and I'm no where near you....lol Sure hope everything goes alright. Make sure you keep your doors and windows locked at night...this whole thing with the neighbor has me on edge.

Congratulations on your property line addition!!! That's great news!!! Maybe your neighbor will be too busy being upset with his wife that he won't even notice that his property has changed!!!

Thanks ladies.
I've contacted the county zoning office and they said to just go ahead and put up our fence ON the boundary line since we did already do that survey. I told them the situation here, so they will be aware of it should the neighbor contact them. We will be putting down wood posts in concrete, so removing them will be a major job should he decide to attempt it.

I also contacted the county sherffis dept and spoke with them. They're putting me on a notification list so hopefully they'll be letting me know when he's going to be released from jail and I can make a point of having company or being gone when he arrives. I'd just as soon not be here alone when he discovers his empty house and the survey markers. I'd like to at least give him time to cool off before I have to see him.

Thanks for your concern Janet. I'm not taking any chances that I can avoid in regard to him. I know he's a potential threat and don't let my guard down at all around him. Physically I'm no match for him, and he's irrational and violent by nature, so I know better than to tangle with him.

Dh is in town getting his DOT physical so will be home shortly. He will be around until Sunday morning so we plan to get at least the cemented posts in today and tomorrow.
